Terms of Use

These Terms of Use ("Terms") govern your access to and use of the AI JobFit web site, applications and related services (collectively, the "Service") provided by AI JobFit. By accessing or using the Service you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

AI JobFit provides software tools that help job seekers and career coaches optimize resumes, match resumes to job descriptions, generate tailored application materials, and surface recommendations using machine learning and other technologies. Features, pricing, availability and exact functionality may change from time to time.

2. Eligibility

You must be at least 18 years old and able to form legally binding contracts to use the Service. By using the Service you represent and warrant that you meet these requirements and will comply with these Terms.

3. Account Registration

Certain parts of the Service require creating an account. When you register you agree to provide accurate and complete information and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

4. Subscriptions and Billing

Some features of the Service are available only via paid subscriptions. By purchasing a subscription, you authorize us to charge the payment method you provide. Subscription fees are exclusive of taxes, unless otherwise stated. We may change pricing and fees at any time; changes will not affect active billing periods without notice.

5. Free Trials

We may offer free trials or promotional access. At the end of any trial period you will be charged if you do not cancel before the trial expires. Trial terms are subject to change and are provided at our discretion.

6. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes, without limitation: (a) violating laws or third-party rights; (b) uploading malicious code; (c) attempting to gain unauthorized access to the Service; or (d) using the Service to send spam or unsolicited communications. We reserve the right to investigate and take appropriate action for suspected violations, including suspending or terminating accounts.

7. User Content

You retain ownership of the content you submit ("User Content"). By submitting User Content you grant AI JobFit a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the content as necessary to provide the Service. You represent that you have all rights and permissions to submit the content and that it does not violate these Terms.

8. Intellectual Property

The Service and all content provided by AI JobFit (including software, designs, text, graphics and trademarks) are owned or licensed by AI JobFit and are protected by intellectual property laws. Except for the rights explicitly granted in these Terms, no right, title or interest is transferred to you.

9. Third-Party Integrations

The Service may integrate with third-party services (job boards, social networks, etc.). Your use of those integrations may be subject to additional terms from the third party. We are not responsible for third-party content or services.

10. Privacy

Our Privacy Policy explains how we collect, use and share personal information. By using the Service you consent to our collection and processing of data as described in the Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI JOBFIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT RESULTS WILL BE ACCURATE. AI RECOMMENDATIONS ARE PROVIDED FOR INFORMATIONAL PURPOSES AND DO NOT CONSTITUTE PROFESSIONAL ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI JOBFIT AND ITS AFFILIATES, OFFICERS, DIRECTORS AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO AI JOBFIT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold AI JobFit and its officers, agents and employees harmless from any claim, demand, loss or damages, including reasonable attorneys' fees, arising out of your use of the Service, violation of these Terms, or infringement of any third-party rights.

14. Termination

We may suspend or terminate your access for violation of these Terms or for any lawful reason with notice when required. Upon termination, paid services will be handled in accordance with our refund policy (see below) and your right to access the Service will end.

15. Refunds

Refunds, if any, are granted at our discretion and in accordance with the subscription terms presented at purchase. Contact support for refund requests.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which AI JobFit is incorporated, without regard to conflict of laws rules. Any disputes will be resolved in the state or federal courts located in that jurisdiction, unless otherwise agreed in writing.

17. Changes to These Terms

We may modify these Terms from time to time. Material changes will be posted with a notice and an updated "Last updated" date. Your continued use of the Service following changes constitutes acceptance of the updated Terms.
